Terms of Service & EULA

DESKTOP LICENSE AGREEMENT

Last Updated: October 24, 2026

1. Acceptance of Terms

By downloading, installing, activating, or using the WickScribe desktop application ("Software"), you agree to be bound by these Terms of Service and End-User License Agreement ("EULA"). These terms govern both your initial 14-day evaluation period and your licensed use of the Software. If you do not agree to these terms, do not install or use the Software.

2. License Grant, Device Limits & Restrictions

WickScribe offers a 14-Day Free Trial beginning upon your first launch of the Software. After the 14-day evaluation period expires, the Software requires a valid desktop license key—available for a one-time payment via our Merchant of Record, Dodo Payments—to unlock continued access. To activate your license, click the Trial button in the top corner next to the Settings button inside the application and paste your license key.

Upon purchasing a license key, you are granted a revocable, non-exclusive, non-transferable, personal license to install and use the Software for your individual trading analysis. Your license key is strictly limited to a maximum of two (2) concurrently activated devices (across macOS and Windows). If you wish to migrate your license to a new computer, you may self-serve deactivate your current device at any time directly within the WickScribe application settings.

You strictly agree not to:

  • Share, resell, distribute, or publicly post your Dodo Payments license key.
  • Modify, tamper with, or delete OS Keychain / Windows Credential Manager entries for the purpose of resetting or bypassing the 14-day trial timer or the 2-device activation limit.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Software binary.

We reserve the right to remotely deactivate and revoke any license key found to be shared, abused, circumventing the device limits, refunded, or subject to a payment chargeback.

3. Strictly Not Financial Advice

WickScribe is purely a local data-entry, visualization, market replay, and journaling utility. It is not a brokerage, execution platform, or financial advisor. Nothing generated or displayed by the Software—including but not limited to Expected Value (EV) calculations, Maximum Favorable/Adverse Excursion (MFE/MAE) metrics, VWAP/EMA indicators, AI trade audits, or account drawdown trackers—constitutes financial, investment, legal, or tax advice.

Trading futures, equities, and derivatives involves substantial risk of loss and is not suitable for every investor. All trading decisions you make are strictly at your own risk.

4. "AS-IS" Software & License Scope

Except for our explicit 14-Day Money-Back Guarantee, the Software is provided "AS-IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Your one-time purchase grants you access to the Software version available at the time of purchase. While we strive to maintain a high-quality desktop experience, the developer makes no binding legal commitment or guarantee to provide future feature updates, third-party API schema updates, or compatibility patches for future macOS or Windows operating system releases.

5. Absolute Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the developer, creator, or distributors of WickScribe be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This explicitly includes, without limitation:

  • Financial losses incurred in live, funded, or simulated financial markets.
  • Breached, failed, disqualified, or terminated evaluations or funded accounts with Proprietary Trading Firms (Prop Firms).
  • Discrepancies or inaccuracies in CSV execution parsing, timezone conversions, commission/fee schedules, MFE/MAE math, or drawdown calculations displayed by the Software.
  • Loss, deletion, or corruption of your local SQLite database (trades.db), custom playbook tags, or local screenshot files.

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the use of the Software shall strictly not exceed the actual amount you paid for your license key.

6. Third-Party Services & APIs (BYOK)

The Software includes optional integrations with third-party providers—including Databento (for historical market data) and OpenAI, Google Gemini, Anthropic Claude, and Ollama (for AI trade analysis)—via a "Bring Your Own Key" (BYOK) architecture. We have no control over, and assume no responsibility for, third-party API downtime, rate-limit changes, data inaccuracies, AI "hallucinations," or any usage fees billed directly to you by those external providers.
